TruePosition Wins Permanent Injunction
<p><strong>Berwyn, Pa. — Aug. 5</strong><br />TruePosition Inc., a provider of wireless location solutions and a subsidiary of Liberty Media Corp., announced the United States Delaware District Court issued a permanent injunction prohibiting Andrew Corp. from making, using, selling or offering to sell control channel Uplink Time Difference of Arrival (U-TDOA) location technology. </p><p>The subject of a patent held by TruePosition, control channel U-TDOA technology is crucial for location-based safety and security applications. <br /> <br />The court also awarded damages in the amount of $18.6 million with respect to prior sales of control channel U-TDOA location technology that Andrew made to the Saudi Telephone Co. (STC). The court then increased that amount by 25 percent — to $23.25 million — because of Andrew’s willful infringement and awarded TruePosition pre- and post-judgment interest. In making this award, the court remitted damages for future lost profits that the jury awarded to TruePosition following a two-week trial of the case in September 2007. <br /> <br />“This is a major win for TruePosition,” said Frederic Beckley, executive vice president and general counsel of TruePosition. “This decision not only affirms the value of our extensive patent portfolio, but also secures our position as the only provider of a crucial location technology.”<br /> <br />In a prior case, TruePosition obtained a settlement from Andrew Corp. worth $42 million with respect to certain TruePosition patents not involved in the present case. The prior case is TruePosition Inc. v. Allen Telecom Inc.<br /> <br />TruePosition is the largest company solely dedicated to location-based safety and security solutions in the world. It holds more than 40 U.S. patents in wireless location technology and more than 100 patents abroad. TruePosition network-based, wireless location technology is deployed nationwide in the United States and is used to locate wireless subscribers who dial 911. </p><p>TruePosition location solutions include Cell ID (CID), Enhanced Cell ID (E-CID), Angle of Arrival (AOA), Uplink Time Difference of Arrival (U-TDOA) and Assisted GPS (A-GPS).<br /></p>
